Conditions
The Goods:

All descriptions and illustrations in the Seller’s catalogues price lists and advertisements or otherwise communicated to the Buyer shall not form part of the contract but shall be treated as approximate only unless otherwise stated.

Not withstanding that a sample of the Goods may have been exhibited to and inspected by the Buyer the Goods shall be taken by the Buyer at its own risk as to their corresponding with the sample and their quality condition or fitness for any purpose.
The Buyer shall determine the suitability of the Goods for their intended use and the Buyer shall not rely on any representations made by or on behalf of the Seller.
Price:
1. The price to be paid for the Goods will be the Seller’s list price prevailing upon the date upon which the Buyer’s order for the Goods is accepted by the Seller.
2. The Seller shall be entitled to adjust the price to be paid for the Goods by such amount as it thinks fit at any time before agreed despatch of the Goods in the event of any increase in the cost to the Seller in supplying the Goods, whether such increase shall result from higher costs of raw materials labour, transport or other overhead expenses, or from any other cause whatsoever.
3. The Seller shall be entitled to make an additional charge for postage and packaging.
Payment:
Part Payment is required when you supply your photos to Dreammontage. Work will not commence until deposit payment is cleared. Final Dreammontage will not be sent until full payment is cleared.
Supply, Delivery & Risk:
Every effort is made to meet delivery dates but a fixed date, shall not be a condition of the supply of the Goods.

Late delivery shall not be a ground for cancellation or refusal to take delivery of the Goods and the Seller shall not be deemed liable for any loss including consequential loss or damages resulting from such delays.

The Seller shall no be liable for any delay in delivery or non-delivery of the Goods caused by any circumstances beyond the Seller’s control, including, without limitation and Act of God explosion, fire, flood, war, hostilities, accident, delay in delivery or non-delivery by the Seller’s supplies breakdowns or accidents to machinery, labour strike or dispute, order of decree or any court or action of any Governmental authority, or any other causes or any circumstances whatsoever beyond the Seller’s control and, on the occurrence of any of the above events, the Seller reserves the right to cancel or suspend the whole or part of any delivery.

Where the Seller concludes the contract of carriage and/or insures the Goods in transit the Seller shall be deemed to be acting solely as the Buyers agent and sections 32(2) and 33(3) of the Sales of Goods Act 1979 shall not apply.

If the Goods or any part thereof are damaged or lost while in the custody of a carrier, the Seller will at its sole option, either replace such Goods or such part thereof, or refund to the Buyer the cost or price of the same, but in no circumstances whatsoever shall the liability of the Seller in connection with any such Goods or part thereof exceed the cost of replacement of the same or the price paid by the Buyer for the same.

Risk or loss or damage to the Goods shall pass to the Buyer at the time of delivery.

Dreammontage cannot be held responsible for the quality of image reproduction or colour matching, from photos supplied by the customer, but will endeavour to get the best quality possible from them.

All work will be sent to the customer by Royal Mail Special Delivery. Please note that this insures your articles up to £500.
Dreammontage can not be held responsible for lost post.
We currently attempt to supply your finished Dreammontage within 14-21 days from clearance of your payment. If you have an urgent order it is always advisable to contact us to discuss your requirements
Data & Privacy:
The information collected from you at the time you place an order (on you or those you gift to) will be stored in our database and is used purely to carry out your instructions and action your payment. There are no circumstances under which, this information might be passed to a third party.
Copyright:
1.All copyright, trade marks and all other intellectual property rights in the Web site and its content (including without limitation the Web site design, text, graphics and all software and source codes connected with the Web site) are owned by or licensed to Dreammontage or otherwise used by Dreammontage.co.uk as permitted by law.
2. In accessing the Web site you agree that you will access the content solely for your personal, non-commercial use. None of the content may be downloaded, copied, reproduced, transmitted, stored, sold or distributed without the prior written consent of the copyright holder.
3. By placing an order the customer expresses their right to reproduce the supplied image under copyright law. All photographs and negatives provided for restoration, printing or archiving are accepted on the strict understanding that the provider owns copyright or permission has been obtained from the owner in writing. The customer is absolutely liable for any resulting violation of copyright action taken by any third party.
Miscellaneous:
The contract between the Seller and the Buyer for the supply of goods shall be governed and construed in accordance with the Laws of England and the Buyer agrees to submit to the jurisdiction of the Courts of Law in England in respect thereof.
No forbearance or indulgence shown or granted by the Seller to the Buyer shall in any way affect or prejudice the right of the Seller against the Buyer or be regarded as a waiver of these conditions.
